Alertena ("the Service", operated by Alertena, "we", "us") is a multi-tenant notification delivery platform. It lets you send push notifications, emails and related messages to your own end users through our API, SDKs, the Alertena mobile app, Web Push and other supported channels.
By creating an account or using the Service you agree to these Terms, the Privacy Policy and the Acceptable Use Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.
You must provide accurate information, keep credentials confidential and be at least 18 years old (or the age of majority in your jurisdiction). You are responsible for everything that happens under your account and API keys.
We may suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or that create risk for other customers or the infrastructure.
You retain ownership of the messages and data you send through the Service ("Content"). You grant us a limited license to process, store and transmit Content solely to operate the Service.
You are solely responsible for the lawfulness of your Content and for having a valid legal basis (consent, contract or legitimate interest) to message each recipient, including any required opt-in for push notifications and marketing email.
Secret keys (sk_…) must be kept server-side. Publishable keys (pk_…) may be embedded in client code as documented. You must rotate any key you suspect is compromised.
You must not probe, scan or test the Service for vulnerabilities without written permission, exceed documented rate limits, or attempt to access another tenant's data.
We target high availability but do not warrant uninterrupted or error-free operation. Delivery to end users additionally depends on third parties (Apple APNs, Google FCM, browser vendors, SMTP providers) outside our control.
We may modify, suspend or discontinue features with reasonable notice where practicable. Material changes to these Terms will be announced in the dashboard or by email; continued use after the effective date constitutes acceptance.
Where paid plans apply, fees are billed in advance, are non-refundable except as required by law, and exclude taxes. We may suspend service for overdue accounts after notice.
The Service, SDKs, documentation and branding are our property. No rights are granted except the limited right to use the Service as documented during the subscription.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALERTENA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR USD 100 IF YOU PAID NOTHING).
You will indemnify and hold us harmless from claims arising out of your Content, your messages to end users, your violation of these Terms, or your violation of applicable law (including KVKK/GDPR and anti-spam rules).
You may stop using the Service and delete your account at any time. On termination we delete or anonymize your data within a reasonable period, except backups and records we must keep by law.
These Terms are governed by the laws of Türkiye, without regard to conflict-of-law rules. The courts of Istanbul have exclusive jurisdiction, except where mandatory consumer law provides otherwise.
